You should ask politely and wait for them to get ready. If they are at the mailbox or auction house, slapping a charter to their face may kick them out no matter what they are doing. Other players who are willing to sign your charter for free may refuse to sign if you don't ask first.
Return to the Guild Master and register your charter. And now can see a guild name under your name.
You can ask before throwing a Guild Charter in someone's face. If people are not in a guild, that doesn't mean they would like to sign your charter.
